Terms of Service

These Terms of Service govern your use of Caper, a spontaneous micro-adventure app operated by an independent developer. By creating an account or using Caper you agree to these Terms. If you do not agree, do not use the app. You must be at least 16 years old to use Caper.
What Caper is
Caper suggests playful real-world micro-adventures ("capers" or "quests"). Quests are suggestions for inspiration and entertainment only. Caper does not organise, supervise, or participate in any activity you undertake.
Safety and your responsibility
You alone decide whether and how to attempt a quest. When you do, you agree to:
— use common sense and your own judgment;
— obey all applicable laws and local rules;
— never trespass, harass, or endanger yourself or others;
— get the consent of anyone a quest involves before involving them.
If a quest seems unsafe, unlawful, or inappropriate where you are, skip it and draw another. To the maximum extent permitted by law, we are not liable for any injury, loss, damage, or legal consequence arising from your participation in a quest.
Your account
Provide accurate information, keep your credentials secure, and use one account per person. You are responsible for activity on your account. You can delete your account at any time in the app (Account → Delete Account).
Your content
You own the photos and recap text you save in Caper. You grant us a limited licence to store and display this content back to you — this is needed to operate the service and ends when you delete the content or your account. Public share links show the quest card only, never your photos or notes. Do not upload content that is unlawful or infringes anyone else's rights.
Acceptable use
Do not misuse the service: no attempts to break or circumvent security, no scraping, no disrupting the service for others, and no use of Caper to facilitate unlawful activity.
Disclaimer and limitation of liability
Caper is provided "as is" and "as available", without warranties of any kind. We do not guarantee the service will be uninterrupted or error-free. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us to use Caper. Nothing in these Terms limits rights you have under mandatory consumer law.
Apple App Store
If you downloaded Caper from the Apple App Store, Apple's Standard End User Licence Agreement also applies. Apple is not responsible for the app or its content and has no obligation to provide support or handle claims relating to it.
Termination
We may suspend or terminate accounts that violate these Terms. You may stop using Caper or delete your account at any time.
Governing law
These Terms are governed by the laws of Portugal. Nothing in this clause deprives you of consumer protections that apply in your country of residence.
Changes and contact
If we change these Terms, we will update this page and the "last updated" date; for material changes we will let you know in the app. Questions: support@caper.today.
